FINGOGO Platform Privacy Policy

1. Introduction

FingogoStar (Thailand) Co., Ltd. ("the Company" or "we"), the provider of the Fingogo application, an on-demand platform for ride-hailing, food delivery, and other services, recognizes the importance of protecting the personal data of all its users.

This policy describes how we collect, use, disclose, and protect your personal information, whether you are a customer, driver partner, or merchant partner on the Fingogo platform.

This policy is in accordance with the Personal Data Protection Act B.E. 2562 (PDPA) and related laws of Thailand.


2. Company information and certifications from government agencies.

The company has received certification from the Department of Land Transport of Thailand as a legally authorized provider of an electronic passenger transport service, in accordance with the Department of Land Transport's announcement regarding the characteristics and operating system of electronic systems, B.E. 2564 (2021).

3. Scope of application.

This policy applies to the following individuals who use the Fingogo platform.

Customer — An individual who uses the Fingogo app to request transportation services, order food, or other services.

Driver Partner — An individual registered to provide driving or delivery services on the platform.

Merchant Partners — Restaurants, shops, or businesses registered to sell goods/services through the platform.


4. Personal information we collect.

4.1 Customer

The information you provided includes your full name, phone number, email address, profile picture (if available), shipping address, and payment information such as credit/debit card, bank account, or e-wallet.

Data generated from usage includes real-time location (GPS), ride request and order history, payment history, conversation logs with drivers or merchants, ratings and reviews given to drivers or merchants, and device information such as Device ID, OS, IP Address, and browser type.


4.2 Driver Partner

The information you provide us includes: full name, date of birth, phone number, and email address; a copy of your national ID card or passport; driver's license and its copy; a self-portrait and profile picture; vehicle information such as license plate number, make, model, color, and insurance policy; bank account number for receiving income; and a criminal record (for background checks as required by law).

Data generated from usage includes real-time location while accepting jobs, trip records and driving routes, customer ratings and reviews, online/offline status and working hours, and device and application information.


4.3 Merchant Partners

The information you provide us includes: store or business name, primary contact person's name and surname, phone number and email address, store address and GPS coordinates, business documents such as business registration certificate and operating license, copy of owner's or authorized person's ID card, bank account information for receiving payments, store photos, logo, and menu images.

Data generated from usage, order history and sales, store opening and closing times and order status, customer ratings and reviews, payment information, and financial reports.


5. Purpose of using the data.

5.1 For service provision: matching customers with drivers or merchants, tracking and displaying real-time locations, processing payments and issuing receipts, and sending trip and order status notifications.

5.2 For safety reasons, verify the identity and qualifications of drivers in accordance with the Department of Land Transport standards, prevent fraud and suspicious transactions, and investigate complaints and disputes.

5.3 For service development: Analyze user behavior to improve the platform, test and develop new features, and generate internal reports and statistics.

5.4 For communication and marketing purposes: Sending promotions, special offers, and news (only with your consent), and notifying you of changes to policies or terms of use.

5.5 To comply with the law, follow orders from government agencies or courts, maintain records as required by law, and report to the Department of Land Transport in accordance with the certification conditions.


6. Legal basis for data processing.

Fulfilling the contract — to provide the services you requested.

Consent — for sending marketing materials and collecting data that is not necessary for providing the service.

Legitimate interests — for security, corruption prevention, and service development.

Compliance with the law — when there are legal requirements that must be met, including announcements from the Department of Land Transport.


7. Disclosure of information to third parties.

We may disclose your personal information only to the extent necessary to the following individuals:

The driver receives the customer's name, phone number, and pick-up/drop-off location.

Customers receive the driver's name, profile picture, and vehicle information.

The store receives the customer's name and shipping address to prepare the order.

Payment service providers — for conducting financial transactions.

Cloud and technology service providers — for technical infrastructure.

Department of Land Transport — Subject to certification number 013 and as required by law.

Other government agencies — pursuant to a court order or as required by law.

Auditors and legal counsel — as needed.

We will never sell your personal information to third parties for marketing purposes.


8. Sending information abroad.

In the event that we need to send your data to another country, such as an international cloud server, we will take appropriate protection measures and strictly comply with Section 28 of the Personal Data Protection Act B.E. 2562 (2019), ensuring that the destination country has adequate data protection standards.


9. Data retention period.

User account information — for the entire account lifespan and for 3 years after account closure.

Travel and order history — 5 years

Financial information and receipts — 7 years according to accounting law.

GPS location recording — 1 year

Driver identity verification documents – for the duration of the contract and for 3 years after the contract ends.

Conversation log — 1 year

Complaint record — 5 years


10. Rights of the data subject.

You have the following rights under the Personal Data Protection Act B.E. 2562 (2019).

Right of access — to request to see the personal information we hold.

Right to correction — Request correction of inaccurate or incomplete information.

Right to delete — Request that data be deleted when it is no longer needed.

Right to suspend use — Request to suspend processing in certain situations.

Right to data portability — to request access to data in a machine-readable format.

Right to object — to object to processing for certain purposes.

Right to withdraw consent — Consent can be withdrawn at any time without affecting previous processing.

11. Data security measures.

We employ appropriate technical and organizational measures, including:

Data encryption during transmission and storage (TLS/SSL and AES-256), role-based access control, system activity audit logs, regular system security testing, and employee data protection training.

In the event of a personal data breach, we will notify the Personal Data Protection Commission within 72 hours and inform you without delay, if the incident poses a high risk to your rights and freedoms.


12. Use of cookies and tracking technologies.

The Fingogo application may use cookies and similar tracking technologies for the following purposes:

Essential cookies — for the basic operation of the app. They cannot be declined.

Analytics cookies — used to understand user behavior. Consent is required.

Marketing cookies — consent is required to display relevant advertisements.

You can manage your cookie settings in the application's settings page.


13. Information of a minor.

Fingogo does not allow individuals under the age of 20 to register as drivers, and it does not allow individuals under the age of 13 to use the app without parental consent. If we become aware that we have collected data of minors without their permission, we will immediately delete that data.


14. Policy changes.

We may update this policy from time to time to reflect changes in legal or business operations. We will notify you via in-app notifications or email at least 30 days before the new policy takes effect.

This policy will be in effect from July 30, 2025.
